1. Definitions
"Stonehaven", "we", "us", and "our" refer to Stonehaven, located at 14 Upper Thomson Road, Singapore 574408. "Services" means the residential care, assessment stays, social programmes, and related offerings described on our website. "User", "you", and "your" refer to any individual accessing our website or engaging our services. "Agreement" means these Terms & Conditions together with any service-specific arrangements made in writing.
2. Acceptance of Terms
By accessing our website or engaging any of our services, you confirm that you have read, understood, and agree to be bound by these Terms & Conditions. If you do not agree, please do not use our website or services. You must be at least 18 years of age to enter into this agreement. If you are engaging services on behalf of another person (such as a family member), you represent that you have the legal authority to do so.
3. Service Description
Stonehaven provides elderly care services in Singapore, including Structured Residential Care, Assessment & Orientation Stays, and the Puzzle & Games Social Programme. We reserve the right to modify, update, or discontinue any service at our discretion, with reasonable notice to affected clients.
4. Enquiries and Service Engagement
Submitting an enquiry through our website does not constitute a binding agreement for services. Service engagement begins only when a written service agreement has been signed by both parties. We will provide a clear outline of the services, costs, and terms before any agreement is finalised.
5. Fees and Payment
All fees are quoted in Singapore Dollars (SGD) and are payable in accordance with the terms set out in your service agreement. Current programme fees are: Structured Residential Care at SGD 2,400 per month, Assessment & Orientation Stay at SGD 750 per week, and Puzzle & Games Social Programme at SGD 370 per month. Fees may be revised with at least 30 days' written notice. Payment is due by the date specified in your service agreement. Late payments may incur administrative charges as outlined in the agreement.
6. Cancellation and Termination
For the Residential Care programme, either party may terminate the arrangement with 30 days' written notice. For the Assessment Stay, cancellation made less than 48 hours before the scheduled start date may forfeit the first day's fee. For the Puzzle & Games Programme, one month's written notice is required for withdrawal. We reserve the right to terminate services if a resident's care needs significantly exceed what we are equipped to provide, or if the safety of other residents is at risk. In such cases, we will assist the family in identifying alternative care arrangements.
7. User Responsibilities
When using our website, you agree to provide accurate information in any forms you submit, use the website for lawful purposes only, and not attempt to interfere with the website's functionality or security. When engaging our services, families are expected to provide accurate and complete medical and personal information relevant to care planning, keep contact details current, communicate any changes in the resident's condition or needs, and settle fees in accordance with the agreed schedule.
8. Intellectual Property
All content on our website โ including text, images, graphics, logos, and design elements โ is the property of Stonehaven or its licensors and is protected by Singapore's intellectual property laws. You may view and print pages for personal, non-commercial use. You may not reproduce, distribute, or modify any content without our prior written consent.
9. Disclaimers
Our services are provided with professional care and attention, but we do not warrant specific health outcomes or improvements. The information on our website is for general informational purposes and does not constitute medical advice. Care plans are developed in consultation with families and healthcare professionals, and outcomes may vary depending on individual circumstances.
10. Limitation of Liability
To the extent permitted by Singapore law, Stonehaven's total liability arising from or related to these terms or any services provided shall not exceed the total fees paid by you in the six months preceding the event giving rise to the claim. We shall not be liable for any indirect, incidental, or consequential damages. Nothing in these terms excludes or limits liability for death or personal injury resulting from negligence, or any other liability that cannot be excluded under Singapore law.
11. Indemnification
You agree to indemnify and hold Stonehaven harmless from any claims, losses, or expenses (including reasonable legal fees) arising from your breach of these Terms & Conditions, your misuse of our website, or any inaccurate information you have provided to us.
12. Governing Law and Disputes
These Terms & Conditions are governed by the laws of the Republic of Singapore. Any disputes arising from these terms or from the provision of services shall be subject to the jurisdiction of the courts of Singapore. Before initiating legal proceedings, both parties agree to attempt to resolve any dispute through good-faith discussion. If the matter cannot be resolved informally within 30 days, either party may seek mediation through the Singapore Mediation Centre.
13. General Provisions
These Terms & Conditions, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Stonehaven regarding your use of our website. If any provision of these terms is found to be unenforceable, the remaining provisions shall continue in full effect. Our failure to enforce any right or provision shall not constitute a waiver of that right. We may assign our rights under these terms to any successor or affiliate. You may not assign your rights without our written consent.
14. Changes to These Terms
We may update these Terms & Conditions from time to time. Changes will be reflected by an updated effective date at the top of this page. Continued use of our website or services after changes are published constitutes acceptance of the revised terms. For material changes affecting existing service agreements, we will provide direct written notice.
